Naildash Terms of Service

Welcome to Naildash. By creating an account or using the Naildash mobile and web application (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully.
1. Eligibility
You must be at least 13 years old to use Naildash. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may delete your account at any time from the Profile screen in the app. Account deletion permanently removes your personal data, design uploads, bookings, and chat history within 30 days.
3. Service Description
Naildash connects customers with nail salons and independent nail technicians. The Service is free to join for customers and partners, and all payment for services is made directly to the salon — Naildash does not process service payments and does not collect deposits. A "connection fee" may apply to bookings with salons that are not on a paid subscription plan (see Section 8).
4. Color Confirmation Before Service
Because every salon carries a different color palette, the customer's booking flow includes a feature to capture the exact color tone and matching color code, and to send a photo of the polish before the service begins. This applies to every color, including black and white, so that the information shown matches the actual polish bottle.
Refunds related to color:
- This step is intended to prevent disputes where a customer is unhappy with the chosen color after the service is complete and requests a refund. Naildash does not provide refunds based on a color-selection mismatch once the service is done.
- If a customer chooses to change the color during the service, that decision is strictly between the customer and the technician, and the app will not refund the customer based on that change.
- If a dispute or issue arises between the customer and the technician during the service that prevents the service from being completed, that service is considered non-refundable.
- Naildash can only step in to help protect the customer and find a resolution based on the four finished-result photos uploaded by the technician after the service has been successfully performed.
- Uploading the four finished-result photos is mandatory for the technician to close out a completed service. If the technician does not upload all four photos, the customer is entitled to request a refund.
5. Nail Art Designs and Quality Standard
Because nail art designs are highly personalized, the app only collects specific parameters during booking — the nail shape, the apex (curve), and the nail length. The nail art design itself is evaluated by Naildash based on the four finished-result photos uploaded by the technician.
A rating of 8 out of 10 is considered the benchmark standard for a successfully completed, personalized result based on the design the customer requested.
6. Salon Partners and Technicians
Salon partners and nail technicians are independent businesses. Naildash is not responsible for the quality of services provided, scheduling, pricing, or disputes between customers and salons. All bookings are subject to the salon's acceptance.
Salon eligibility and registration:
- Naildash is open to salons with a real, verifiable physical business location. Home-based businesses are not eligible to register.
- Registration is free; however, the salon must provide official bank account information registered under the name of the nail business.
- When a customer submits a service request or quote request, the identity and exact location of the salon are kept confidential until the request is accepted.
7. Customer Privacy in Booking
Each time a customer submits a service or quote request, the specific identity and address of the salon remain hidden until a salon accepts the request and a booking reference code is issued.
8. Connection Fee and Subscription Plans (Salons)
Naildash earns through an optional monthly subscription and, for non-subscribed salons, a connection fee. This policy is shown and explained to salon owners during registration.
- Connection fee (Free-plan salons): For salons on the Free plan, each booking carries a 10% connection fee — 10% on the salon and an additional 10% shown to the customer — before the booking reference code is issued. The customer is clearly informed that the salon is not on a paid plan.
- Use App Free (customer wallet): The customer's 10% connection fee is held in the customer's in-app wallet as a rolling credit that automatically covers the connection fee of the customer's next booking. It is never taken as Naildash revenue. After the first top-up, the customer maintains a rolling balance and pays no additional fees on future bookings. This wallet balance is used toward the customer's future bookings in the app and is not paid out as cash.
- App-payment protection (quality guarantee): When the customer pays the 10% connection fee and pays through the app, Naildash protects the customer's right to a refund if the service is not satisfactory. Product quality is reviewed by a Naildash nail technician and must score at least 8/10 to be considered up to standard.
- Subscribed salons: Salons on any paid plan are fully exempt from the connection fee for both the salon and the customer.
- Radius subscription plans (per month): $59.99 — reach customers within 3 miles; $79.99 — within 5 miles; $99.99 — within 10 miles. A paid plan waives all connection fees.
Card-processing surcharges may apply where permitted by state law and are disclosed before checkout.
9. User-Generated Content (UGC)
You may post photos, comments, design requests, and chat messages on Naildash ("User Content"). You retain ownership of your User Content but grant Naildash a non-exclusive license to display it within the Service.
You agree NOT to post any content that is:
- Abusive, threatening, harassing, hateful, or discriminatory
- Obscene, sexually explicit, or pornographic
- Violent, illegal, or promoting illegal activity
- Defamatory, false, or misleading
- Spam, unsolicited advertising, or scam content
- Infringing on intellectual property rights of others
- Contains personal information of other people without consent
Zero tolerance for objectionable content and abusive users: Naildash reserves the right to remove any User Content that violates these Terms and to suspend or permanently ban users who post objectionable content.
10. Reporting and Blocking
If you encounter content or a user that violates these Terms, you can:
- Report the content using the "Report" option (three-dot menu) on any post, comment, or chat message.
- Block any user using the "Block" option in their profile or chat header. Blocked users cannot contact you or see your content.
Naildash reviews all reports within 24 hours and takes appropriate action — including removal of content and account suspension or permanent ban — for confirmed violations.
11. Prohibited Conduct
You may not use Naildash to:
- Violate any law or regulation
- Impersonate another person or entity
- Interfere with or disrupt the Service or servers
- Use automated tools (bots, scrapers) without permission
- Attempt to gain unauthorized access to other accounts or data
12. Termination
Naildash may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time from the Profile screen.
13. Disclaimer
The Service is provided "as is" without warranties of any kind. Naildash is not liable for any damages arising from your use of the Service or from interactions with salons, technicians, or other users.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
